Kochi : The Kerala High Court has come down heavily up on Jacob Thomas, who is serving suspension, while considering his sub petition seeking protection under Whistleblowers Protection Act for himself and his family. The court has said: “Jacob Thomas is a public servant and not a public master.” The HC also reminded that all are equal in front of the law.
“As a public servant, Jacob Thomas cannot become a public master. There are power centres above Jacob Thomas also. A public servant must stick with fulfilling duties entrusted on him. Decisions cannot be forced on anyone,” said the court. Jacob Thomas had approached the HC seeking legal protection for himself and his family under the Whistleblowers Protection Act. He has alleged in his petition that he is continuously being targeted, ridiculed, and being hunt down as he’s standing against corruption. He also said that he’s not sure whether he’d get the protection from the state government, and that he had already written to the Prime Minister and the vigilance pointing out that there’s threat to himself and his family but there has been no response yet. Nevertheless, the government had informed the court that Jacob Thomas did not have to face any action.
The government has also said that what Jacob Thomas is doing is as part of his official duty and hence there is no need to give him any protection under the Whistleblowers Protection Act. The court has given time to Jacob Thomas till next Monday to file a counter Affidavit against the affidavit submitted by the government.
