The Allahabad High Court ruled that the requirement to publish a notice of intended marriage under Special Marriage Act won't be mandatory. The HC observed that mandating such publication invades the fundamental rights of liberty and privacy. It was hearing a petition that alleged that an adult girl was detained against her wishes to marry her lover from another religion.
